You should be aware, however of tactics that attorneys may use to make a witness less sure of their answers. These techniques include:

• Turning pages of a book as they ask the questions.

• Asking the question more than once or asking if you are sure of your answer.

• Asking the question in an incredulous tone of voice.

• Asking a question more than once, or asking if you are sure.

Look for and then ignore these traps. You should only be testifying to things you know are true. Since you are only going to say things that you are certain are true, enjoy the defense attorney’s theatrical attempts to throw you off.

So, you got lucky this time. But what if you weren’t lucky? What should you have said?

"The bruise was on the right ear."

Regardless of which ear the bruise was on, Nevaeh’s bruise looked a lot more like a pinch mark.
